DALLAS TWP. &#8212; After hearing hours of testimony, the township Zoning Board on Monday again continued an appeal hearing on an addiction treatment center without reaching any decision.David Rowland Interests Inc.&#8217;s appealed a denied permit application for development of the drug rehab center in an agricultural zone. The board heard testimony, but took no vote on the matter it was initially expected to do.Monday&#8217;s meeting was the second continuance of an initial hearing in May. A third continuance is scheduled for 6 p.m. June 30 at the municipal building, at which time the board does plan to vote.Zoning Board Solicitor Philip Gelso explained at the opening of the meeting that the township had raised an issue and requested an opportunity to present additional evidence.During the meeting, additional testimony and cross examination was made. Questions were raised from both sides regarding the propriety of procedures followed in the case to that point and the advertising of the hearing.The proposed site for the 70-bed inpatient addiction treatment center is the former Commonwealth Health Back Mountain Medical Center, 100 Upper Demunds Road. The company, which is a real estate development, management and investment business, initially filed the application in February, at which time it was denied by Township Zoning and Code Enforcement Officer Carl Alber.Alber has said prior to the first hearing that he denied the application based on the Dallas Township Zoning Ordinance&#8217;s restrictions for A-1 (agricultural) districts. He explained this type of facility is not permitted by the code.The company, however, claims they were never given proper written notice of the application denial.The company then filed to appeal Alber&#8217;s decision to refuse certification of zoning compliance or certification of nonconformity, and it seeks a special exception to change one nonconforming use to another.The hearing process began May 11, and after three hours of testimony, the board agreed to a May 28 continuance. When the board still did not reach a conclusion after another four hours of testimony and cross-examination on that date, Monday&#8217;s continuance was scheduled. All parties, at that time, were given the opportunity to submit proposed findings of fact and conclusions of law.At Monday&#8217;s meeting, it was announced that all parties have one week to submit new proposed findings of fact and conclusions of law before the final hearing June 30.

No decision reached on rehab center by Dallas Twp. Zoning Board
