First Posted: 12/12/2014 SCRANTON &#8212; Federal prosecutors are seeking more than eight years in prison for James Presley, a convicted murderer caught with a handgun during a traffic stop near Hazleton earlier this year.
Presley, 43, is scheduled to be sentenced Monday in U.S. District Court on a charge of unlawful possession of a firearm and ammunition by a convicted felon. Presley is asking for a five year sentence.
State police at Hazleton stopped a 2004 Ford Explorer that Presley was driving for speeding and swerving in the lane of travel on Interstate 80 near the Interstate 81 junction on May 15.
Presley told a trooper he and the passenger, Kareshia Cargile, who was a passenger, were on their way to Erie.
A records check showed Presley was convicted of third-degree murder in Philadelphia in 1992 and served 13 years in prison of a seven to 14-year sentence.
Cargile, who was not charged, permitted troopers to search the Ford.
A loaded handgun and ammunition were found in a trash bag mixed with clothing, according to the criminal complaint.
State police said Presley claimed ownership of the handgun at which he said he purchased for $100 in Erie in 2013.
The handgun was reported stolen to state police at Uniontown on Jan. 10, 2013, the complaint says.
While state police filed charges against Presley, the case was presented before a federal grand jury that returned an indictment against Presley on July 15.
Presley pleaded guilty to the federal charge on Sept. 12.
In their request seeking eight years in prison, federal prosecutors claim Presley has been in trouble with the law since he was 19-years-old and has convictions for drug possession, firearms violations, drug trafficking, possession of contraband by an inmate and murder.
U.S. District Court Judge James M. Munley is scheduled to sentence Presley on Monday.
