First Posted: 12/2/2013 WILKES-BARRE &#8212; Luzerne County prosecutors have filed their response to accusations of misconduct during the 2011 retrial of James Lincoln Strong for a 1981 murder along Interstate 81 in Dorrance Township.
In documents filed last week, attorneys for Strong, 61, claim several flaws, including improper admission of description of victim John Henry Strock&#8217;s &#8220;good character traits,&#8221; as well as discussion of Strong&#8217;s criminal past and a prosecutor improperly speaking to a witness.
Strong was first convicted in 1984 in the shotgun slaying of John Henry Strock, with whom he and another man, James Alexander, had hitched a ride in August 1983.
The state Supreme Court overturned Strong&#8217;s conviction in November 2000, ruling that he did not receive a fair trial because prosecutors failed to reveal they had a deal with Alexander in exchange for his testimony at the initial trial.
Strong was convicted at trial again in 2011, and is challenging his 2011 conviction in the case before state Superior Court.
Prosecutors replied on Monday that the jury was advised that statements by attorneys are not evidence, that reference to the victim did not address guilt or innocence and that the brief conference with a witness was disclosed to the court, and that her testimony was not admitted.
