WILKES-BARRE &#8212; A habitual DUI offender is headed back to prison on his usual charge.Richard Ostrander Jr., 51, of Pittston, was sentenced Wednesday in Luzerne County Court to three years to five years and nine months in state prison on two DUI charges, one count of unauthorized use of a motor vehicle and one count of driving with a suspended license, according to court papers.Judge Tina Polachek Gartley credited the man for 166 days served, court documents indicate.Court papers say Ostrander must pay a $2,500 fine and $134 restitution. He also must perform 35 hours of community service and his license is suspended for 18 months.According to a criminal complaint, police arrested Ostrander on April 12, 2014, after a woman reported at about 11:42 a.m. the man had stolen her car to drive to Exeter. Responding officers located Ostrander sitting in the woman&#8217;s car, parked where she said he would be going.The complaint says the police found an open, cold can of beer in a front-seat cupholder as well as an odor of alcohol coming from his person. Police say the man&#8217;s eyes were red and glossed over and his speech was slurred.Court papers say Ostrander exhibited a blood-alcohol content of .300. An adult driver in Pennsylvania is considered intoxicated with a BAC of .08 percent.Ostrander&#8217;s record for driving under the influence stretches as far back as March 1989, according to online court records.
