West Pittston church holds fall yard sale

<p>KINGSTON TWP. &#8212; City Wide Towing proprietor Robert Kadluboski and Plymouth police are at odds about an illegally parked van that was removed from private property on West Shawnee Avenue earlier this year.</p><p>Kadluboski said he towed the Ford Econoline van at the request of Plymouth Code Enforcement Officer Carl Telesco, but borough police are refusing to verify the vehicle&#8217;s owner through the vehicle identification number.</p><p>Acting police chief Ryan Williams said he is prohibited from accessing the state Department of Transportation&#8217;s database to determine who owns the van because the vehicle was removed from private property and proper paperwork was never completed.</p><p>Kadluboski and Plymouth officials argued their positions during a summary trial before District Judge James Tupper in Kingston Township on Wednesday.</p><p>Kadluboski filed a civil complaint with District Judge Donald Whittaker in Nanticoke in June seeking $1,500, which includes court filing fees and storage of the van at his storage yard. The hearing was moved to Tupper due to a conflict of interest with Whittaker, who presides over civil and criminal issues in Plymouth.</p><p>Telesco testified he inspected the West Shawnee Avenue apartment building and advised the property manager a van blocking a cellar door had to be moved. The property owner then had Kadluboski tow the van.</p><p>Telesco said he never called or asked Kadluboski to tow the vehicle from private property.</p><p>Kadluboski, who could not recall the date he towed the van, said he made numerous attempts to contact Telesco and police to have the vehicle identification number checked with PennDOT. Kadluboski said he needed to know the owner of the van to send a certified letter to the owner that the vehicle had been towed and stored in his storage yard.</p><p>&#8220;I need to notify the (owner) that their vehicle was towed. These (Plymouth officials) put me in this situation,&#8221; Kadluboski said.</p><p>Plymouth solicitor Michael Kostelansky and Williams said it was the responsibility of the property owner to complete PennDOT paperwork because the vehicle had been towed from private property.</p><p>Williams said police follow certain procedures when vehicles are towed from private and public properties. Williams said he is also unable to access PennDOT&#8217;s database because the proper paperwork was not completed by the property owner.</p><p>Kadluboski countered, saying police departments he deals with frequently verify owners of vehicles he tows.</p><p>Before the hearing, Kadluboski offered to withdraw the civil complaint if police would confirm the van&#8217;s owner through PennDOT. When no deal was reached, the hearing took place.</p><p>Kadluboski said the van remains in his storage yard.</p><p>Tupper said he will issue a decision within the next week.</p><style>
