SWOYERSVILLE &#8212; A dispute over an alleged nuisance property is pitting a legion of residents against a storied veterans organization.At two consecutive meetings of borough council, several residents within earshot of an outdoor pavilion and horseshoe pit built outside American Legion Post 644 on Shoemaker Street petitioned members of council to intervene and put an end to the noise and live music they claim has gone above and beyond bearable.According to a transcript of the Aug. 3 meeting of borough council, at least six residents from Gillespie and Warsaw streets petitioned the six-member council to address the noise, which they claim comes from blaring live music and rude, rowdy guests.One resident said people attending a recent bazaar at the pavilion ran through her yard, parked in her driveway and then grew agitated when asked to move the vehicle. Another claimed the noise was so loud it drowned out his television set.Borough solicitor Joseph Yeager did not attend last week&#8217;s borough council meeting, leaving residents without a resolution.Tom Kobusky, treasurer of the Legion&#8217;s Home Association, said the organization has begun to address the issue, planting tree barriers and building a band tent inside their pavilion to lessen noise.He also said the venue has been operating within the parameters of the Swoyersville Noise Ordinance as far as allowable decibel levels and time of night that live music is acceptable, but added that complainants have done nothing to work with legion officials beyond presenting their initial opinion.&#8220;We&#8217;ve offered multiple times to have them attend meetings, and they&#8217;ve refused,&#8221; said Kobusky. &#8220;We need them to cooperate and let us know what we can do for them.&#8221;Joe Ruscavage, the borough zoning officer, said a zoning hearing occurred in 2011 and those within 100 feet of the proposed site were notified, according to the transcript. After answering additional questions, Ruscavage told residents the time to address issues was during the hearing, not four years later.But residents in the area said the antics at the pavilion this summer were louder than ever.Lana Chinikaylo, who lives on Gillespie Street about 30 feet from the pavilion, said she was told &#8220;tough luck&#8221; after asking to have music turned down so her 3-year-old daughter could sleep. Her husband, whom she said works from 6 a.m. to 6 p.m., also reported the noise to the Swoyersville Police Department.Mayor Chris Concert said just two noise complaints regarding the pavilion have been filed with the police department.&#8220;I feel like they just don&#8217;t even care,&#8221; Chinikaylo said Wednesday. &#8220;As long as they&#8217;re getting money out of it, what&#8217;s it to them that we can&#8217;t continue living our life?&#8221;&#8220;They don&#8217;t live here. They don&#8217;t know what it&#8217;s like,&#8221; she added.While some residents grow impatient with the issue, Concert said others have threatened legal action. But he doesn&#8217;t believe that showdown needs to happen.
