First Posted: 2/7/2014 WILKES-BARRE &#8212; Former Luzerne County Clerk of Courts Robert F. Reilly maintains that county Judge Jennifer Rogers erred in finding that a federal crime to which he pleaded guilty should result in a total forfeiture of his county pension.
Reilly, who was convicted of lying to FBI agents who questioned him about money he received from a county contractor, was sentenced in November 2010 to serve two years of probation.
He filed suit in December 2010 to regain his pension. In papers filed last summer, both sides asked the court for summary judgment in the case. In December, Rogers ruled in favor of the county retirement board, finding there was no material difference between the federal crime and a similar state statute.
Attorneys for Reilly, who is appealing the case to Commonwealth Court, on Friday filed a concise statement of their argument, writing that Rogers&#8217; reading of the two laws was wrong.
