<p>WILKES-BARRE TWP. &#8212; Attorneys involved in the permitting of the all-nude<a href="https://www.timesleader.com/news/500107/new-owners-new-name-for-strip-club-in-busy-retail-dining-and-entertainment-hub" target="_blank"> Teaser&#8217;s Gentlemen&#8217;s Club </a>dismissed concerns raised by the owner of a similar business formerly on site as off-the-mark.</p><p>Teaser&#8217;s opened with a liquor license on Jan. 7 at the former Gentlemen&#8217;s Club 10 on Mundy Street which had operated as a bring-your-own-bottle club, a distinction Salvatore Scalzo said necessitated new permits and approvals.</p><p>Independent legal opinions sought by Wilkes-Barre Township noted the difference, but pointed out the new club, just like the old one, provides adult entertainment and as a result does not have to go through a new permitting process. Additionally, the new club owners planned to continue to operate a strip club on the premises and never abandoned the use permitted to Club 10.</p><p>Scalzo, of Harding, said Tuesday he stands by statements he made in a Jan. 4 letter to a Times Leader reporter about what he saw as &#8220;improprieties&#8221; on the part of the township, the new owner, JAMME Holdings LLC and Teaser&#8217;s. He also said he expected the reaction after a legal battle to open the former Club 10 and it&#8217;s closing in August 2014 due to financial reasons.</p><p>&#8220;Given the circumstances of the closure and my former landlord&#8217;s subsequent actions to form JAMME Holdings LLC and once again operate a strip club at this once quite lucrative location, I have no doubt that any actions I would directly take to raise awareness of these concerns with Wilkes-Barre Township government would be only met by lukewarm response and accusations of &#8216;sour grapes&#8217; at the loss of my club,&#8221; Scalzo said.</p><p>Attorney Matthew Croslis, of Allentown, representing JAMME Holdings, said his client &#8220;obtained all necessary governmental permits&#8221; to get Teaser&#8217;s up and running.</p><p>Even though the new owner, which listed Donna Delbalso-Amato and Harry T. Heizer Jr., a South Carolina attorney, as active members of the business, has a similar sounding name to JAMME-K Inc., the former club&#8217;s owner, there was no attempt to confound the township, Croslis said.</p><p>&#8220;Every governmental body or agency involved knew at all times that Teasers was in no way related to the prior business owner, Mr. Scalzo or his company Jamme-K, Inc.,&#8221; Croslis said.</p><p>Club 10 obtained a conditional use permit in 2004 and eventually opened two years later after a legal fight over the township&#8217;s attempt to regulate and restrict the entertainment proposed for the business in the heart of the growing retail, entertainment and dining hub around the Mohegan Sun Arena at Casey Plaza.</p><p>Two independent opinions from attorney Patrick Kane, of Archbald, to zoning and code enforcement officer Thomas Zedolik clarified the conditional use permitting issues with the change in ownership.</p><p>In the Oct. 23, 2014, opinion, Kane wrote that within three months of Club 10&#8217;s closing the new owners had sought to continue the same operations, well within the one-year benchmark &#8220;to establish intent to abandon. &#8220;</p><p>On Sept. 18, 2015, Kane issued another opinion on whether the liquor license granted to JAMME Holdings changed the use of the business.</p><p>Up until 2006, Pennsylvania Liquor Control Board regulations prohibited lewd entertainment in any establishment having a liquor license, Kane wrote. But a federal appeals court struck down the prohibition, he added.</p><p>&#8220;The only aspect of the club that will change is that it will no longer be considered a BYOB adult entertainment establishment. This in and of itself does not constitute a change of use under the zoning ordinance,&#8221; Kane wrote.</p><style>
