<p>WILKES-BARRE &#8212; An alleged drug dealer charged in the attempted execution-style shootings of two people last year wants her homicide charges dropped.</p><p>Wandalee Balcacer, 26, is seeking to have one felony count each of attempted homicide and criminal conspiracy to commit homicide tossed on claims prosecutors failed to present &#8220;reliable evidence and testimony&#8221; at a preliminary hearing in October, according to a document filed Thursday in Luzerne County Court.</p><p>According to a criminal complaint, Balcacer and Philadelphia gang member Tony &#8220;Hazard&#8221; Edwards, 28, attempted to kill Sherry &#8220;Chyna&#8221; Rivera and Izhar Ramos-Martinez in a hallway at the Interfaith Heights apartment complex on April 4 in a dispute over a $4,000 drug debt.</p><p>Both Rivera and Ramos-Martinez sustained gunshot wounds to their heads but survived.</p><p>John I. McMahon Jr., Balcacer&#8217;s attorney, wrote that prosecutors failed to provide &#8220;any competent, reliable evidence or testimony at the preliminary hearing to establish, even by inference, that defendant harbored a &#8216;specific intent to kill&#8217; as is necessary to sustain a charge of attempted murder.&#8221;</p><p>McMahon argued that the only eyewitness with first-hand knowledge of the incident, Neieesha Morris, established nothing more than Balcacer&#8217;s presence at the scene of the shootings.</p><p>The rest of the testimony &#8220;consisted of contradictory and inadmissible hearsay statements&#8221; shared between law enforcement outside of the court proceedings.</p><p>McMahon wrote that Morris had testified that Balcacer called her in tears on the night of the incident and said &#8220;that wasn&#8217;t supposed to happen. I was just supposed to fight,&#8221; indicating Balcacer showed no intent to kill.</p><p>Testimony from Wilkes-Barre police painted a more gruesome story.</p><p>Detective Matthew Stash, based on witness accounts collected during his investigation, had testified that Balcacer actually held Rivera on the ground and made her look at Ramos-Martinez before they were shot.</p><p>It was at that time that Stash testified that witnesses heard Balcacer say &#8220;shoot the (expletives) already.&#8221;</p><p>Both Balcacer and Edwards are scheduled to be formally arraigned on the charges Friday in Luzerne County Court.</p><style>
