Police charge Joe Lombardo in another armed robbery case

<p>WILKES-BARRE &#8212; The frantic screams on the 911 audio tape were at some points inaudible. Other times, just difficult to hear.</p><p>&#8220;He&#8217;s dying on me. He&#8217;s dying on me and he&#8217;s not moving,&#8221; the voice of Jessica Lynn Alinsky sobbed. &#8220;I&#8217;m covered in (expletive) blood and he&#8217;s not moving.&#8221;</p><p>For more than a half hour, the recording went on. &#8220;Matt, I love you,&#8221; Alinsky said at one point. &#8220;Please don&#8217;t leave me.&#8221;</p><p>So began testimony Tuesday in the trial of Alinsky, who faces up to life in prison on charges she shot her 34-year-old boyfriend Matthew Gailie in the face, then altered the scene inside the couple&#8217;s Hazle Township living room to make the death appear like a suicide.</p><p>In the 33-minute-long recording, 911 operator Gina Domashinski attempted to calm an extremely distraught Alinsky, 32, who had phoned in the incident just after 11:30 p.m. on Sept. 2, 2011.</p><p>Domashinski testified that Alinsky told her she and Gailie had gotten into a fight and Gailie had shot himself. Alinsky later heard a gunshot and found Gailie on the living room floor bleeding from the nose and mouth, Domashinski said.</p><p>Alinsky can be heard in the recording pleading repeatedly with Domashinski to send help.</p><p>&#8220;Where are they?&#8221; Alinsky screamed in the recording. &#8220;He&#8217;s bleeding and you don&#8217;t (expletive) care.&#8221;</p><p>Defense attorney Demetrius Fannick said Alinsky urged the operator to send help not because she wanted Gailie dead, but because, &#8220;She wanted him to live.&#8221;</p><p>On the night of Gailie&#8217;s death, Alinsky had been out drinking with co-workers, Fannick told jurors during his opening statement. She was allegedly so drunk that she was cut off and kicked out of Bottlenecks Bar, he said.</p><p>Fannick added the evidence will show Gailie had alcohol in his system as well.</p><p>Despite being drunk, Alinsky didn&#8217;t plan an argument, nor did she expect one, Fannick said, adding she didn&#8217;t know that the dispute would escalate or that it would involve a gun.</p><p>Fannick acknowledged the couple&#8217;s relationship was &#8220;volatile,&#8221; but said the evidence presented by the defense will show there was nothing planned by Alinsky on Sept. 2, 2011, and that the argument that night was provoked by Gailie.</p><p>Prosecutors painted a different picture of the young couple.</p><p>&#8220;It&#8217;s a tale of manipulation,&#8221; Assistant District Attorney Jill Matthews said, &#8220;of lost control.&#8221;</p><p>Alinsky was used to having control over Gailie, Matthews told the jury of seven women and five men. When she was losing grasp of that power, the Shenandoah native committed &#8220;willful murder,&#8221; Matthews said.</p><p>Their relationship was one that started out like most others, only it didn&#8217;t end that way, Matthews said.</p><p>&#8220;It ended with murder,&#8221; she said.</p><p>Neighbor Tracey Grohol, 43, and her son, 21-year-old Sam Grohol, testified that they both heard a single gunshot around 11:34 p.m., but neither initially believed the sound to be gunfire.</p><p>Tracey Grohol stated she heard what sounded like a firecracker, so she went downstairs and onto her deck to look outside. She went back upstairs and went to bed, but was later woken when her son came into the room and told her the police were outside.</p><p>She then went back out onto the deck.</p><p>&#8220;I could hear what sounded like a woman crying,&#8221; Grohol said, adding the voice sounded &#8220;agitated, upset, angry - as if she was trying to get a point across.&#8221;</p><p>Sam Grohol, a U.S. Marine corporal, said in a recorded interview that he woke up because he heard the &#8220;distinct sound&#8221; of a gunshot at around 11:34. He later heard a female screaming.</p><p>Fannick argued that the incident occurred over Labor Day weekend, and that the two could have been hearing fireworks.</p><p>&#8220;I&#8217;m assuming it would be unusual to hear a gunshot at your home?&#8221; Fannick asked Sam Grohol. &#8220;Since you had your phone in your hand at the time, did you call state police to report a gun shot?&#8221;</p><p>&#8220;No, sir,&#8221; Sam Grohol responded.</p><p>State trooper John Chulock later later testified he arrived on the scene at around 12:11 a.m. and heard Alinsky screaming from his patrol car.</p><p>While additional responders were arriving over the course of the next two hours, Chulock said Alinsky provided him &#8220;several&#8221; voluntary accounts of what had happened, including multiple stories that conflicted with one another.</p><p>At one point, Chulock said Alinsky stated, &#8220;Why is it loaded? It&#8217;s never loaded.&#8221;</p><p>Fannick stated during cross-examination that Alinsky flagged Chulock down and made no efforts to hide from the officer, as someone who committed a crime would have likely done.</p><p>The trial is scheduled to resume Wednesday at 9 a.m.</p><style>
