<p>WILKES-BARRE &#8212; The Luzerne County District Attorney&#8217;s office will retry one of three inmates whose first trial for allegedly participating in a riot at the State Correctional Institution at Dallas resulted in a hung jury.</p><p>Prosecutors in a filing in county court Friday said they intend to go forward with another trial for Carrington Keys on charges of aggravated harassment by prisoner. Keys allegedly threw feces at guards during the April 29, 2010 riot.</p><p>The riot charges against Keys, Andre Jacobs and Duane Peter will be dropped, the filing said.</p><p>The DA&#8217;s office asked that the court schedule a hearing on the dismissal of the charges, to amend the criminal information against Keys and to discuss new dates for a trial.</p><p>The notice was in line with a statement assistant district attorney James McMonagle Jr. issued after the jury reached a deadlock April 13 and Judge Lesa S. Gelb declared a mistrial. McMonagle said prosecutors would meet and determine whether to retry the case.</p><p>The three inmates, part of the so-called &#8220;Dallas Six,&#8221; were charged after they allegedly barricaded themselves in their cells in the restricted housing unit at SCI Dallas.</p><p>A team of guards forcibly extracted the men, along with fellow inmates Anthony Locke, Anthony Kelly and Derrick Stanley, from their cells after they failed to comply with several orders to remove bedding covering their cell doors &#8212; a violation of the prison&#8217;s code.</p><p>Keys, 35, Jacobs, 34, and Peter, 44, were the last of the group to be prosecuted on the rioting charges, according to court records. They have been separated and incarcerated at different prisons throughout the state.</p><p>Kelly, 32, pleaded guilty to the rioting charge and received up to 14 months in prison.</p><p>Locke, 37, a fourth member of the group, was acquitted of a riot charge and convicted instead of a misdemeanor count of disorderly conduct.</p><p>Stanley, 45, entered a no contest plea to a count of resisting arrest after prosecutors withdrew the riot charge. Gelb sentenced Stanley to 95 to 190 days in prison, but he was released after receiving credit for 196 days served, court records show.</p><style>
