<p>WILKES-BARRE &#8212; A city man accused of attacking his uncle is heading to county court.</p><p>Police said David Fierman hit his uncle so hard, the impact nearly caused his uncle&#8217;s ear to become detached from his head.</p><p>Fierman, 28, appeared before District Judge Thomas Malloy Sr. for a preliminary hearing Thursday.</p><p>Fierman waived charges of simple assault, use or possession of drug paraphernalia and harassment to higher court. His single charge of aggravated assault was withdrawn.</p><p>According to the criminal complaint:</p><p>Police were dispatched to a residence on Hayes Lane at 1:39 a.m. on Feb. 15 for a report of a domestic disturbance. Police advised that the victim sustained injuries to his head, and that his ear was &#8220;sliced.&#8221;</p><p>Police arrived to find Fierman sitting on the front porch. Fierman reportedly told officers &#8220;no one is pressing charges as of yet.&#8221;</p><p>Officers then encountered the victim with a laceration on his right ear that was &#8220;bleeding heavily and barely attached to his head.&#8221; Police determined the victim was an uncle of Fierman&#8217;s.</p><p>As the victim received treatment on the scene, he told police he told Fierman that he felt bad that he lost his residence in Harrisburg. Police said the victim allowed Fierman stay with him until he could find a new place to stay.</p><p>The victim told police Fierman&#8217;s behavior was &#8220;intolerable&#8221;</p><p>At 11:45 p.m. on the night of the attack, the victim, who works as a taxi driver, returned to his residence to use the restroom between fares. The victim reported that Fierman was &#8220;increasingly intoxicated&#8221; at the time. The victim then told Fierman to leave, which police said led to Fierman packing a bag then attacking the victim in the hallway.</p><p>The victim reported that Fierman began hitting him, and described to police a &#8220;very hard thud&#8221; on the right side of his head, which he said prompted Fierman to return packing his things.</p><p>The victim then went to the bathroom and discovered that his ear was nearly detached, according to police.</p><p>While at police headquarters, Fierman was found in possession of a metal pipe with black residue that police said had an odor of burnt marijuana. Fierman also allegedly told an officer that he uses the pipe to smoke marijuana.</p><p>Fierman is scheduled for a formal arraignment at 10 a.m. on May 4 in the Luzerne County Courthouse. He remains jailed for lack of $35,000 bail.</p><style>
