Luzerne County 911 to receive $1.3 million in computerized phone upgrades

County: Federal money for tornado unlikely

<p>WILKES-BARRE &#8212; A man serving a lengthy state prison sentence for killing a woman in a drunken hit-and-run crash in 2015 challenged Monday a request to subpoena his prison phone records in an ongoing civil lawsuit filed by the victim&#8217;s husband.</p><p>Michael Scavone, 51, of Harveys Lake, was <a href="https://www.timesleader.com/news/547184/michael-scavone-pleads-guilty-in-fatal-harveys-lake-hit-and-run-sentenced-to-7-to-16-years" target="_blank">sentenced to seven to 16 years in state prison in May after he pleaded guilty</a> to running down Paula Jones, 31, of Factoryville, as she jogged along Lakeside Drive in Harveys Lake on June 7, 2015.</p><p>Jones&#8217; husband, Brian Jones, <a href="https://www.timesleader.com/news/377526/husband-of-triathlete-killed-in-harveys-lake-sues-driver-two-businesses" target="_blank">filed a civil suit shortly after the crash,</a> alleging wrongful death and seeking damages against Scavone, American Legion Post 672 in Dallas and several defendants associated with the Grotto Pizza bar and restaurant in Harveys Lake &#8212; two locations where Scavone was allegedly drinking before the crash.</p><p>In a brief filing Monday in Luzerne County Court, Scavone objected to a subpoena that seeks his phone records at State Correctional Institution Camp Hill from June 2016 to Jan. 31.</p><p>The &#8220;overly broad&#8221; subpoena requests privileged information, such as his conversations with his attorney, and would only produce irrelevant information, he argued.</p><p>A repeat DUI offender who allegedly told investigators he spent the day of the incident drinking beer and Yukon Jack, Scavone fled the scene of the crash and was later found sleeping at his mother&#8217;s house.
