West Pittston council to borrow $1M for roads, public works site

<p>WILKES-BARRE &#8212; The former manager of a Schuylkill County personal care home who admitted to stealing nearly $395,000 in residents&#8217; monthly rent checks allegedly at his father&#8217;s urging was sentenced Wednesday to 27 months in federal prison.</p><p>Scott Capparell, 46, of Drums, served as administrator of Heritage Mills Personal Care and Memory Assist Center in Tower City from 2013-2016. He <a href="https://www.timesleader.com/news/638399/drums-man-accused-of-stealing-395k-from-residents-of-personal-care-home" target="_blank">admitted in February</a> to underreporting the number of residents on a monthly basis and diverting $394,517 into a separate bank account. He then falsified records to cover his tracks, prosecutors said.</p><p>According to a sentencing memorandum, the fraud was discovered when Capparell&#8217;s father, who managed the facility and was a part-equity owner, invested in a separate facility and needed the diverted funds to repay an investor in another facility.</p><p>Joseph Capparell Sr. instructed his son to divert the funds so the investor could be paid back, the memorandum said. Scott Capparell received &#8220;scant economic benefit&#8221; from the fraud, according to the memorandum, filed by defense attorney Frederick J. Fanelli.</p><p>&#8220;Mr. Capparell&#8217;s poor decision-making was the product of a misguided sense of loyalty to his father with the false belief that his father would ultimately make things right with the Heritage Mills investors,&#8221; Fanelli wrote.</p><p>Fanelli did not immediately return a message seeking comment. Federal prosecutors declined to comment Joseph Capparell Sr.&#8217;s alleged role in the fraud.</p><p>Records show Capparell Sr. died in 2016, a few months before his son was charged. He was 73.</p><p>U.S. District Judge Richard P. Conaboy ordered Capparell to make full restitution. He must serve two years of supervised release following his prison term.</p><p>The charges stemmed from an FBI investigation.</p><style>
