New DUI measures go into effect this week

<p>WILKES-BARRE &#8212; Attorneys defending the owners of the Sherman Hills apartment complex in a suit filed by a man shot in a stairwell three years ago identified the alleged gunman in the unsolved assault and said he is liable for the damages sought by the victim.</p><p>No criminal charges have been filed against alleged shooter LeQuan Graham, of New York, and it was unknown if investigators were aware of the information about him contained in a court document.</p><p>The victim, Kody Gamble, whose last known address was Hanover Street in Wilkes-Barre, said he did not know Graham and referred to him only as a &#8220;Thug&#8221; in the lawsuit seeking in excess of $75,000 in damages.</p><p>A call to the Wilkes-Barre City Police Department detective division was not immediately returned Thursday. Luzerne County District Attorney Stefanie Salavantis declined comment.</p><p>The suit against Sherman Hills, initially filed in September 2016 in Luzerne County and later transferred to U.S. District Court in Scranton, alleged the new owners were careless and negligent by failing to ensure Gamble was safe, despite giving the impression to the public they were going to improve security at the complex that had a history of crime and violence.</p><p>Gamble said he went to building 304 on North Empire Court the afternoon of Sept. 14, 2014, to visit a friend and was near a stairway when the &#8220;Thug&#8221; entered through an unlocked door and asked him questions.</p><p>&#8220;Unprovoked and without warning, the Thug pulled a .380-caliber handgun and fired one shot in Kody&#8217;s direction, striking him in the neck area,&#8221; the filing states.</p><p>A police press release from the day of the shooting said Gamble, who was 19 at the time, described the shooter as &#8220;some black guy&#8221; and refused to answer questions as he was transported by ambulance to Geisinger Wyoming Valley Medical Center.</p><p>In the Aug. 8 filing that identified Graham, the attorneys for Sherman Hills said he was exclusively responsible for Gamble&#8217;s injuries and damages. They asked that either Gamble&#8217;s complaint be dismissed and they be awarded costs of suit, attorneys fees and other relief deemed proper by the court or find against Graham and in favor of the owners.</p><p>Attorney Jeremy Weinstock, of the Comitz Law firm in Wilkes-Barre that represents Gamble, declined comment on the pending litigation.</p><p>Attorney Elizabeth Underwood of Philadelphia, representing complex owners Treetop Development LLC and The Aspen Companies LLC of Teaneck, N.J., also declined comment.</p><style>
