Men plead not guilty to WB homicide; family asks why it happened

<p>WILKES-BARRE &#8212; A New Jersey man allegedly tried to escape custody with a handcuff around his wrist after he wrested away from city police officers investigating a disturbance at the Sherman Hills apartment complex over the weekend.</p><p>Police said a pellet gun altered to give it an appearance of a handgun fell from the waistband of Malik Omar Moore, 33, during the struggle in a hallway at 328 Parkview Circle on Saturday.</p><p>Moore was arrested when he was stunned by a Taser, police said.</p><p>According to a criminal complaint:</p><p>Police responded to the complex when Moore kicked in a door in an attempt to force it open to access a woman&#8217;s apartment at about 12:20 a.m.</p><p>The woman told police Moore was drinking in her apartment earlier in the day, but she did not want him to return.</p><p>Moore refused to show his hands and kept one hand near his waistband.</p><p>Moore struggled with two officers and yelled, &#8220;You&#8217;re not arresting me.&#8221; An officer managed to secure one of Moore&#8217;s wrists in handcuffs but Moore managed to break away, running down a hallway to a stairwell.</p><p>An officer caught with up Moore, who continued to struggle.</p><p>A pellet gun that appeared to be a handgun fell from Moore&#8217;s waistband as he fought with officers.</p><p>Police stunned Moore with a Taser before his wrists were secured in handcuffs.</p><p>Officers found a plastic bag of suspected marijuana and a scale in Moore&#8217;s backpack.</p><p>Moore was arraigned by District Judge Brian Tupper in Kingston Township on charges of illegal possession of a weapon, simple assault, resisting arrest, criminal trespass, escape, disorderly conduct, criminal attempt, possession of a small amount of marijuana and possession of drug paraphernalia. He remained jailed Tuesday at the Luzerne County Correctional Facility for lack of $150,000 bail.</p><style>
