<p>KINGSTON &#8212; A Kingston man is facing charges after police accused him of breaking into a Market Street apartment in June.</p><p>Justin Daniel Curat, 22, was released on $5,000 unsecured bail after he was arraigned by District Judge Brian James Tupper on charges of trespassing and use and possession of drug paraphernalia.</p><p>According to the criminal complaint:</p><p>Borough officers responded to a call June 2 that a man was attempting to break into an apartment at 947 W. Market St.</p><p>When officers arrived at the scene, the caller told police the male fled from the scene; however, there was a broken window with apparent fresh blood on the glass.</p><p>The caller also advised that a tenant moved out of apartment number 105 and changed the locks to the apartment. A relative came to the building prior to June 2 and was told that he was not allowed on the property.</p><p>The caller continued to tell police that the relative who showed up earlier in the day, later identified as Curat, demanded to retrieve property from the apartment.</p><p>When Curat was confronted by the caller stating he could not enter the apartment, Curat allegedly threatened to assault him and break into the apartment.</p><p>Police identified a man matching the description of black male dressed in silver clothing walking along Market Street.</p><p>When Curat was stopped, officers observed him with a blood on his right hand.</p><p>When officers asked Curat if he had been to the apartment at 947 W. Market St., he told them the locks has been changed but denied breaking the apartment window.</p><p>Curat had an active warrant from the Wilkes-Barre City Police Department for his arrest.</p><p>Police also discovered that Curat had a marijuana grinder and empty bags of suspected marijuana in a bag that he had been carrying.</p><p>He was then taken into police custody at police headquarters.</p><style>
