Police: Man beaten with hammer in tool-truck assault

<p>AVOCA &#8212; Cell phone records are being reviewed by Luzerne County detectives and borough police in connection with a fatal pedestrian accident on Main Street last week.</p><p>A Luzerne County judge permitted detectives to search the cell phone of Gerald J. Dimick Jr., of Scranton, who police say was driving a Jeep Grand Cherokee that struck Leonard L. Ferlick Jr.</p><p>The accident happened Aug. 9 in front of the Avoca Municipal Building on Main Street.</p><p>Luzerne County Coroner William Lisman said Friday that an autopsy by Dr. Michael Yoder revealed that Ferlick, 72, of Avoca, died from multiple traumatic injuries due to being struck by a motor vehicle. The manner of death is pending the investigation, Lisman said.</p><p>Ferlick&#8217;s obituary says he enlisted in the U.S. Marine Corps and served during the Vietnam War. He worked at the Tobyhanna Army Depot for 31 years.</p><p>According to the search warrant affidavit:</p><p>Dimick told authorities he was traveling south on Main Street and did not see a pedestrian crossing the street because he was blinded by the sun. Dimick claimed he raised his hand to shield his eyes from the sun when Ferlick was struck.</p><p>Ferlick was launched forward and became airborne over the driver&#8217;s side of Dimick&#8217;s Jeep before landing on the pavement. He was transported to Geisinger Wyoming Valley Medical Center in Plains Township, where he died.</p><p>Detectives noted in the affidavit that the roadway was dry and the weather was warm and clear.</p><p>Dimick told authorities at the time of the crash that he was not under the influence of any drugs or alcohol.</p><p>No charges have been filed.</p><style>
