Luzerne County government litigation settlements proposed

<p>KINGSTON TWP. &#8212; A Larksville man accused of consuming a &#8220;pint of vodka&#8221; before driving a pickup truck into Frances Slocum Lake that resulted in the death of a 53-year-old passenger waived his right to a preliminary hearing on Monday.</p><p>Adolph George Rasmovicz, 55, of Pace Street, was charged by the state Department of Conservation and Natural Resources after he drove a Chevrolet pickup truck through a parking lot and down an embankment into the lake on Oct. 10. The crash happened near Carverton Road. </p><p>The crash took the life of Drew A. Obsitos, of Shavertown, who owned the truck.</p><p>Rasmovicz appeared Monday before District Judge Brian Tupper waiving his right to a preliminary hearing, sending a single count of vehicular homicide while under the influence to Luzerne County Court.</p><p>Prosecutors withdrew charges of DUI, careless driving and accidents involving death against Rasmovicz.</p><p>Rasmovicz remains jailed at the county correctional facility for lack of $50,000 bail.</p><p>According to the criminal complaint:</p><p>Paul Rother was in the area when he seen the truck drive down an embankment and into the lake. Rother used a hammer to smash the truck&#8217;s windows removing Rasmovicz and Obsitos.</p><p>Rasmovicz told police at the scene he was driving the truck.</p><p>Obsitos and Rasmovicz were transported to Wilkes-Barre General Hospital.</p><p>Obsitos died Oct. 16.</p><p>While Rasmovicz was being transported to the hospital, emergency medical technicians detected an odor of alcoholic beverages on his breath.</p><p>Rasmovicz allegedly claimed he consumed a pint of vodka and Obsitos drank a pint of Jagermeister.</p><p>Investigators obtained search warrants for Rasmovicz&#8217;s blood to determine his alcohol level.</p><p>Rasmovicz&#8217;s alcohol level of .304 percent, according to the complaint.</p><p>The legal limit is .08 percent.</p><style>
