<p>WILKES-BARRE &#8212; Two women have filed a federal lawsuit against a suspended Ashley officer who is accused of sexually assaulting them, claiming his abuse deprived them of their constitutional rights.</p><p>The suit, which seeks unspecified monetary damages, also claims the officer used a body camera to record the assaults, an allegation not previously indicated in arrest papers.</p><p>Mark Eric Icker, 29, of Dickson City, is facing sex-related charges in three separate cases. He&#8217;s been accused of pulling over women and suggesting they perform oral sex on him to get out of potential charges.</p><p>In a third case, investigators say he drove a woman to her home in the Mountain Top area after pulling her over on suspicion of DUI, then pulled down her shirt and bra to expose her breast.</p><p>The two women who made the oral-sex allegations against Icker filed a civil lawsuit through their attorneys Barry Dyller and Theron Solomon of the Dyller Law Firm of Wilkes-Barre.</p><p>The women filed the lawsuit under the pseudonyms &#8220;R. Doe&#8221; and &#8220;S. Doe&#8221; to protect their identities.</p><p>In the suit, the woman identified as S. Doe claims she was pulled over in Ashley while she was driving home from work on Dec. 2 last year.</p><p>She claims she was not driving erratically, nor was she speeding, giving Icker no reason to pull her over.</p><p>S. Doe further claims Icker performed a search of her vehicle with neither her consent nor probable cause, finding a partially smoked joint hidden in a cigarette package.</p><p>Icker allegedly told S. Doe she would be going to jail.</p><p>The attorneys who wrote the lawsuit point out the possession of a small amount of marijuana, &#8220;the only crime S. Doe could conceivably be charged with,&#8221; carries a maximum term of only 30 days in prison but most often only carries 30 days of probation.</p><p>While S. Doe was handcuffed in the backseat, Icker allegedly asked her multiple times: &#8220;What can you do to help me help you?&#8221; When she asked if he meant sexual favors, Icker allegedly replied: &#8220;That&#8217;s up to you.&#8221;</p><p>&#8220;But it was not up to S. Doe,&#8221; the lawsuit states. &#8220;Icker had unreasonably seized S. Doe, had her in the back of a police car handcuffed, threatened her with felonies and jail, and S. Doe had no idea what else Icker was capable of.&#8221;</p><p><strong>&#8216;Have trophies&#8217;</strong></p><p>The suit, like the criminal complaints against him, claim Icker brought S. Doe to the Ashley Borough Police station, where he forced her to perform oral sex.</p><p>He then allegedly kept her driver&#8217;s license and used her personal information to seek her out on social media.</p><p>Similarly, R. Doe claims she also gave no probable cause to be pulled over when Icker stopped her Dec. 9.</p><p>Icker accused R. Doe of driving under the influence of alcohol, but she claims she did not have anything to drink.</p><p>Unlike S. Doe, R. Doe gave Icker consent to search the vehicle, and Icker handcuffed her. He found prescription medication in the car and accused her of driving under the influence.</p><p>R. Doe says Icker repeatedly asked: &#8220;How can you help me help you?&#8221; He eventually brought her to a park near the police station where she was forced to perform oral sex, charges state.</p><p>The woman smeared Icker&#8217;s semen on her clothes to prove the sex act happened, according to authorities and the civil filing.</p><p>The lawsuit also says Icker wore a body camera during the sexual assaults. The camera was not provided by the department, but had been purchased by Icker himself, the suit says.</p><p>&#8220;Icker&#8217;s purpose in recording the forced sexual encounters with S. Doe and R. Doe was to have trophies memorializing his forced sexual encounters with S. Doe and R. Doe, and so he could repeatedly watch those forced sexual encounters,&#8221; the lawsuit states.</p><p>The women claim, in addition to the alleged sexual assaults, that their constitutional freedoms were denied, specifically those afforded by the Fourth and 14th Amendments.</p><p>They claim that Icker&#8217;s acts amount to illegal search and seizure, and are also a violation of their rights to due process.</p><p>The women are demanding a jury trial and are seeking punitive damages. They also want their attorney&#8217;s fees to be covered.</p><p>Icker remains locked up at the Luzerne County Correctional Facility.</p><style>
