<p>WYOMING &#8212; A property owner has sued Wyoming Borough and two councilmen, alleging political payback as the reason why he hasn&#8217;t been compensated for land they seized for the construction of a pump station on Shulde Lane.</p><p>In the civil suit filed Monday in federal court, Patrick Kane of Susquehanna Realty Group LLC named the borough, Stephen Nalewajko and Francis Yurek as defendants.</p><p>Borough solicitor Lars Anderson said he had not seen the lawsuit and declined comment Tuesday.</p><p>The suit alleges Kane, the sole member of SRG with a business address of Wyoming Avenue, Wyoming, hasn&#8217;t been paid because he supported Joseph Dominick and opposed former Mayor Bob Boyer in 2017. The suit claims that the allies of Boyer retaliated and violated Kane&#8217;s constitutional rights of free speech, protection from unreasonable seizure and due process.</p><p>The suit further alleged the defendants in July 2016 &#8220;were under pressure from the Wyoming Valley Sanitary Authority to construct a pump station.&#8221; They did not follow the state&#8217;s code for eminent domain when they built the project on SRG&#8217;s land, the suit argues. The defendants seized the property &#8220;unreasonably and meaningfully interfered&#8221; with SRG&#8217;s property interests, the filing says.</p><p>It adds that the conduct of the defendants was &#8220;so outrageous that it shocks the conscience or otherwise offends judicial notions of fairness.&#8221;</p><p>The lawsuit was filed in the U.S. District Court for the Middle District of Pennsylvania in Scranton. The plaintiffs are asking for unspecified compensatory and punitive damages, the cost incurred as a result of the alleged unlawful conduct of the defendants, and appropriate and just relief determined by the court.</p><style>
