LUZERNE &mdash; While condemning the message, state Rep. Aaron Kaufer defended the messenger&rsquo;s right of free speech after the district attorney&rsquo;s office decided not to approve charges against the man who scrawled swastikas and references to Hitler and Nazis on a campaign mailer left at the office of the Jewish lawmaker.
				Kaufer Tuesday said he was notified of the decision a day after he was alerted to the mailer stuck inside the door of his office on Main Street in Luzerne.
				&ldquo;It&rsquo;s politically protected free speech. It&rsquo;s outrageous, but people have the political right of free speech,&rdquo; Kaufer said in reaction to the notification.
				&ldquo;It&rsquo;s highly offensive. It&rsquo;s wrong. While somebody has the right to say it, I don&rsquo;t agree with it and it shouldn&rsquo;t be part of our political dialogue,&rdquo; Kaufer, said, adding, &ldquo;I recognize the right to say it.&rdquo;
				Luzerne Police Chief Michael Kotwasinski had been working with the Luzerne County District Attorney&rsquo;s Office after Kaufer contacted police about the mailer. Police identified the person responsible, but Kotwasinski said the district attorney&rsquo;s office determined charges weren&rsquo;t warranted in this case.
				The police chief referred questions to the district attorney&rsquo;s office .
				In a prepared statement released late Tuesday afternoon, the district attorney&rsquo;s office explained its decision:
				&ldquo;The District Attorney&rsquo;s Office has completed its review of the investigation into antisemitic comments posted at Representative Kaufer&rsquo;s Office. As offensive and distasteful as they might be, the posting of the comments without more do not constitute a crime under the Pennsylvania Crimes Code. First Amendment protections notwithstanding, Pennsylvania crimes, including the ethnic intimidation statute and harassment statute require additional acts to be a violation of the Crimes Code. As such, criminal charges cannot be pursued.&rdquo;
				Kaufer, 32, a three-term Republican seeking reelection to represent the 120th District, said he doesn&rsquo;t want to drop the issue.
				&ldquo;I&rsquo;m hoping we can have a good dialogue about what proper political discussion should be,&rdquo; Kaufer said.
				Kaufer drew the line on what was acceptable.
				&ldquo;Some things are out of bounds,&rdquo; Kaufer said. &ldquo;Anytime that swastikas are involved, that just to me should not be part of the dialogue.&rdquo;
				The incident drew the attention of the Anti-Defamation League, the Pennsylvania Jewish Coalition and the Jewish Community Alliance of Northeastern PA. They issued a joint statement Monday:
				&ldquo;We are deeply concerned that a threatening handwritten flier, which reportedly included swastikas and messages calling the Republican Party &lsquo;Nazis&rsquo; and &lsquo;like Hitler,&rsquo; was anonymously left at the office of Pennsylvania State Rep. Aaron Kaufer. &#8203;We are grateful for law enforcement&rsquo;s swift response. No Jewish elected official should have to tolerate being targeted by antisemitic hatred, especially accusing him or a political party of being like &lsquo;Nazis.&rsquo; This is deeply offensive and a perversion of history.&rdquo;
