 WILKES-BARRE -- Criminal investigations of James O'Boyle's death are
winding down quietly, with the state police recently closing one of two active
probes without finding any wrongdoing. &nbsp;&nbsp;&nbsp; 
 Meanwhile, an attorney for O'Boyle's estate said an FBI investigation
appears barely active. The bureau has shown no interest in boxes full of
evidence uncovered in a federal civil case in which O'Boyle's survivors
alleged Wilkes-Barre police beat the 48-year-old city man to death. The city
settled the case out of court for $750,000 but admitted no wrongdoing. &nbsp;&nbsp;&nbsp; 
 "Two to three weeks ago, (we) had conversations with the FBI in Scranton,
and they said they were still interested," said O'Boyle family attorney Al
Flora, referring to the 1991 death of O'Boyle. "But we haven't heard from
them. &nbsp;&nbsp;&nbsp; 
 "Then, (we) sent out a letter the other day saying we intend to close out
our files in a week. We've given them a week to come down and look at our
files," Flora said. &nbsp;&nbsp;&nbsp; 
 In the suit, O'Boyle's mother, Regina, contended city police violated her
son's civil rights. She said police beat her son to death after locking him in
a jail cell on charges of public drunkenness. &nbsp;&nbsp;&nbsp; 
 Police claim O'Boyle probably suffered his fatal injuries in a fall before
his arrest. &nbsp;&nbsp;&nbsp; 
 On Sunday, Luzerne County District Attorney Peter Paul Olszewski Jr.
confirmed that state police had concluded the probe without finding any
wrongdoing. "(There was) no criminal misconduct on the part of anyone,"
Olszewski said. &nbsp;&nbsp;&nbsp; 
 Flora criticized the state-police probe, saying it was unnecessarily
restricted to O'Boyle's movements before his arrest and didn't focus on local
police actions after his detainment. &nbsp;&nbsp;&nbsp; 
 Records indicated O'Boyle was arrested and taken to a local hospital for an
examination of bruises on his head. &nbsp;&nbsp;&nbsp; 
 Doctors released O'Boyle to police, who locked him in a jail cell. Several
hours later, O'Boyle was discovered unconscious and taken back to the
hospital, where he died early the next morning. &nbsp;&nbsp;&nbsp; 
 Olszewski acknowledged the limited nature of the state-police investigation
but referred all questions on the case to the FBI. &nbsp;&nbsp;&nbsp; 
 The FBI has declined to confirm or deny the existence of any investigation
of the matter. &nbsp;&nbsp;&nbsp; 
 Flora also criticized the federal investigation, saying it was handed to
inexperienced agents and never given high priority. &nbsp;&nbsp;&nbsp; 
 "It was very superficial," Flora said, adding that the agent who handled
the investigation was fairly inexperienced. "She botched a reading of a
forensic report, and that upset us greatly," Flora said.
