Contends Nanticoke council's abdication to city manager is unlawful &nbsp;&nbsp;&nbsp; 
 Nanticoke City Council members are in trouble. Deep trouble. Several months
ago council majority members hired a city manager and abrogated their oath of
office when they passed on their civic authority and duties to the out-of-town
managerNanticoke operates under the Pennsylvania Third Class City code, which
it adopted when Nanticoke became a city in the mid-1920s. &nbsp;&nbsp;&nbsp; Council gave the manager a mandate. However, they gave the new manager
unlimited authority to raise the tax millage, to hire and fire city employees. &nbsp;&nbsp;&nbsp; 
 He recently fired two minor city employees, without consulting council or
even notifying the mayor and minority members. At the recent council meeting,
one of the fired former employees approached the mayor and asked why she was
fired. &nbsp;&nbsp;&nbsp; 
 The mayor replied that he was unaware she had been released. The employee,
hired by council, should have been terminated by council with due process.
This was not done; not even a notice was given the former employee. &nbsp;&nbsp;&nbsp; 
 The city manager is attempting to operate the city under the Optional Third
Class City Code. This is illegal. &nbsp;&nbsp;&nbsp; 
 To operate under the Optional Third Class City Code, a change in the code
must be made through a voter referendum. &nbsp;&nbsp;&nbsp; 
 This has not been done, and I believe council is ignorant of that fact. &nbsp;&nbsp;&nbsp; 
 To change the present city government, council must pass an ordinance
creating a study commission, which is given the task of studying the present
form of government to learn if a change is indicated. Then the question is
placed on a ballot, and the voters decide what action, if any, should be
taken. The entire process takes about 18 months. &nbsp;&nbsp;&nbsp; 
 The city is now operating illegally, since there is no provision in the
present code for a city manager. &nbsp;&nbsp;&nbsp; 
 Council members committed a sin when they abolished their authority and
granted it to an unelected clerk (that's all he could be called under the
present city code). &nbsp;&nbsp;&nbsp; 
 Copies of this letter will be sent to the proper authorities in Harrisburg. &nbsp;&nbsp;&nbsp;
