Curley's plea late, says DA &nbsp;&nbsp;&nbsp;

-- It's too late now for Joann Curley to ask for an emergency hearing, the
district attorney says. &nbsp;&nbsp;&nbsp; Curley's petition for an emergency state Superior Court hearing on her
request for bail is unwarranted, in part because she waited so long to file
it, Luzerne County District Attorney Peter Paul Olszewski wrote Friday in an
eight-page response to the request. &nbsp;&nbsp;&nbsp; 
 Curley's lawyer, Frank Nocito, didn't file the Superior Court appeal until
27 days after Luzerne County Court of Common Pleas Judge Correale F. Stevens
denied bail. He waited until Jan. 17, three days short of the deadline, and
"then had the temerity to request an emergency appeal," Olszewski wrote. &nbsp;&nbsp;&nbsp; 
 A preliminary hearing was also delayed 18 days at Nocito's request, further
delaying the judicial process, Olszewski wrote. &nbsp;&nbsp;&nbsp; 
 Nocito had not returned phone calls as of press time Friday night. &nbsp;&nbsp;&nbsp; 
 Nocito's request, which was formally docketed Thursday at state Superior
Court in Philadelphia, argues that Curley deserves to be released on bail
because she has no prior criminal history, has a 9-year-old daughter and has
character witnesses who will vouch for her. &nbsp;&nbsp;&nbsp; 
 Curley was arrested Dec. 12 in connection with the 1991 thallium poisoning
death of her husband, Robert Curley. Olszewski is seeking the death penalty in
the first-degree murder case, arguing that Robert Curley was tortured. Torture
is one of the circumstances punishable by death. &nbsp;&nbsp;&nbsp; 
 Olszewski could not be reached for comment. &nbsp;&nbsp;&nbsp;
