Accused Cop Has History Of Trouble 
Officer Named In Lawsuit Alleging 
Sexual Assault Has Been Accused In 
Court Three Other Times In Last Two Years

WILKES-BARRE TWP. -- The township police officer named in a federal lawsuit
Thursday alleging he sexually assaulted a West Pittston woman has asked for a
temporary leave of absence. &nbsp;&nbsp;&nbsp; 
 In a press release, township officials said officer Scott Brozowski's leave
was granted Friday. &nbsp;&nbsp;&nbsp; "At this point in time, we are taking the matter under advisement and
review, and I have instructed the police Chief, Mayor, and other officials of
the Township not to discuss any details pertaining to the litigation or
allegations," said Bruce Phillips, township solicitor, in the release. &nbsp;&nbsp;&nbsp; 
 In an interview, Phillips said Brozowski is a part-time officer and will
not receive pay during his leave. He also said the borough's insurance company
has been notified of the suit because it alleges Brozowski used his position
as a police officer in the assault. &nbsp;&nbsp;&nbsp; 
 The lawsuit said Brozowski, 26, of Wilkes-Barre, flashed his badge, forced
a woman into his car and then made her perform oral sex on him in the parking
lot of Lispi's Cocktail Lounge last September. Two unidentified men also were
involved in the assault, the suit said. &nbsp;&nbsp;&nbsp; 
 State police are conducting a criminal investigation into the alleged
assault. No arrests have been made. &nbsp;&nbsp;&nbsp; 
 "It would be inappropriate to discuss in detail the allegations set forth
in this lawsuit while the state police are still conducting their
investigation and have not made a determination," Mayor Robert Delescavage
said in the release. &nbsp;&nbsp;&nbsp; 
 A woman who answered the phone at the Brozowski residence said he will be
out of town until next week. &nbsp;&nbsp;&nbsp; 
 Court records show in the last two years that Brozowski has had a
protection from abuse order filed against him; a drunken driving charge, which
led him to enter the Accelerated Rehabilitative Disposition Program for
first-time offenders; and a car accident in Forty Fort resulting in a lawsuit
that claims he fled from the scene of the crash, drunk. &nbsp;&nbsp;&nbsp; 
 The release issued Friday does not refer to the prior court problems, only
the federal suit detailing the assault. &nbsp;&nbsp;&nbsp; 
 Brozowski's attorney, Ferris Webby, said his client was at the bar on the
evening of Sept. 28, but denied he was at the scene of the alleged attack,
which occurred outside the bar after closing. &nbsp;&nbsp;&nbsp; 
 "He doesn't know anything about the incident," Webby said. &nbsp;&nbsp;&nbsp; 
 Brozowski took a lie detector test as part of the investigation, Webby
said, but he refused to explain the results of the test. &nbsp;&nbsp;&nbsp; 
 "I can't confirm or deny if he passed it or not," Webby said. &nbsp;&nbsp;&nbsp; 
 According to the Municipal Police Officer Education and Training Commission
in Hershey, Brozowski was certified and hired as a township police officer in
October 1991. He was last certified with the department sometime before March
31, 1995, said a commission spokesman. &nbsp;&nbsp;&nbsp; 
 Barry H. Dyller, who filed Thursday's complaint against Brozowski, said his
client has identified Brozowski and two other men -- "Bob" and "Cash" -- in
police photographs. &nbsp;&nbsp;&nbsp; 
 "I think it makes sense from his perspective and from the township's
perspective," Dyller said of the leave. &nbsp;&nbsp;&nbsp;
