Luzerne County Domestic Relations support officer Eugene Duffy has been suspended with pay due to a drunken driving charge filed against him, county records show.A blood test showed the 53-year-old West Hazleton man had an alcohol level of .269 percent, which is more than three times higher than the .08 percent that the state considers legally intoxicated, Wilkes-Barre police allege.Duffy was tested after he crashed a vehicle at North River and Chestnut streets just before 12 a.m. on July 7 and exhibited signs of impairment, police said.County Court Administrator Michael Shucosky declined comment on the matter Tuesday, citing personnel confidentiality.The decision about suspension with or without pay is governed by the county Court of Common Pleas personnel code of conduct and human resource policy.For disciplinary purposes, the handling of criminal charges against employees may be addressed differently based on whether they are related to work. In this case, the charge against Duffy occurred when he was off duty.According to the policy:Whenever an employee is formally charged with criminal conduct not related to county employment, the deputy court administrator of human resources must promptly conduct an inquiry and make a preliminary determination on whether the employee should continue performing work duties.Among the factors that must be considered: the extent the accusation of wrongdoing will impact public confidence and trust in the employee, the department and judiciary.In comparison, employees formally charged with a felony or criminal conduct related to county employment must be immediately suspended without pay, the policy says.Duffy receives around $64,260 annually as a domestic relations support officer, county records show.<div class="metaInfo"><bylineMeta>By Jennifer Learn-Andesjandes@www.timesleader.com</bylineMeta></div><div class="metaInfo"><shirttailMeta>Reach Jennifer Learn-Andes at 570-991-6388 or on Twitter @TLJenLearnAndes.</shirttailMeta></div>
