Another emotional senior day up next for Nittany Lions

<p>WILKES-BARRE &#8212; Theron Solomon will have to wait a little longer to see video footage that allegedly implicates his client, Ronald Drayton, in a shooting that occurred in July inside a city nightclub.</p><p>Drayton, 46, appeared before Luzerne County Judge David W. Lupas for a motion hearing on Tuesday. Solomon filed for subpoena of a witness of the case &#8212; namely, a city police officer &#8212; to see surveillance footage from the night of the shooting.</p><p>Assistant District Attorney Mamie Phillips, who represented the commonwealth and filed to quash the subpoena, argued Solomon was trying to &#8220;circumvent the rules of procedure&#8221; and the material would be pre-discovery.</p><p>The motion hearing came before Drayton&#8217;s preliminary hearing and possible formal arraignment.</p><p>Lupas ultimately agreed, and denied Solomon access to the video.</p><p>&#8220;I respect the judge&#8217;s decision,&#8221; Solomon said. &#8220;Unfortunately, I think the ruling is wrong.&#8221;</p><p>Solomon said the prosecution is relying heavily on the surveillance video from the night of the shooting. He said he has interviewed witnesses from that night &#8212; including the victim, Marcese Cloward Grant &#8212; that say otherwise.</p><p>&#8220;None of them put Ronald Drayton as the shooter,&#8221; Solomon said.</p><p>Solomon maintained Drayton&#8217;s innocence, and said the video help to exonerate his client.</p><p>The prosecution also filed for a bail modification, given the severity of Drayton&#8217;s charges. Phillips argued that Drayton is a run risk, but Solomon painted a different picture about his client.</p><p>U.S. Marshal Martin J. Pane announced in September that Drayton was arrested without incident in the 1300 block of Pacific Avenue in Brooklyn in September.</p><p>Solomon explained his client fled the area with his family out of fear for their safety due to his address being publicized by a local newspaper. He also said Drayton has been an active member in the community for many years, and even if he posted bail, he would remain incarcerated due to a retainer on pending federal drug charge.</p><p>Lupas modified Drayton&#8217;s bail from $20,000 to $100,000.</p><p>Drayton is charged with shooting another man inside the Passion Lounge in July. City police on July 10 charged Drayton with discharging a round from a handgun that struck Grant in the leg during a melee inside Passion Lounge on Scott Street. Grant survived the gunshot injury.</p><p>Drayton was charged with six counts of reckless endangerment and one count each of aggravated assault, illegal possession of a weapon and possession of a firearm without a license.</p><p>Drayton is scheduled to appear before Magisterial District Judge Martin Kane for a preliminary hearing at 10 a.m. Nov. 25.</p><style>
