WILKES-BARRE &#8212; A court order and a lien, placed against Paselo Logistics LLC, the owner of the former Huber Breaker, in Ashley, were filed Tuesday.The court order, <a href="https://www.timesleader.com/news/local/521631/per-agreement-huber-breaker-owners-have-10-days-to-begin-cleaning-efforts" target="_blank">made during a compliance hearing Monday</a>, mandates Philadelphia-based Paselo Logistics LLC to clean up the South Main Street, Ashley, site within 45 days.Colleen Connolly, community relations coordinator for the Department of Environmental Protection, said a 30 to 45 day clean up window is standard.The stipulation states that within 10 days of the order, all drums and containers must be secure and Paselo Logistics LLC must initiate the characterization of the contaminated waste. Paselo has 20 days from the order to excavate and consolidate the contaminated soil and place the drums on material that is waterproof so the contaminated liquids in the drums can&#8217;t spill and &#8220;to protect the property from further contamination.&#8221;Within 30 days of the order, all contaminated soil, waste in drums and contains as well as liquid and contaminated debris must be in the pit of the former-maintenance building on the property.The debris and asbestos must be removed from the property and in permitted landfills or facilities within 45 days &#8212; April 29.Progress will be monitored by the DEP.&#8220;We&#8217;ll give them time and space (to clean up the property),&#8221; Connolly said. &#8220;But we don&#8217;t have set times to be on the property.&#8221;The order states noncompliance with the order will result in Paselo Logistics LLC being found in contempt of court.Also filed Monday was a municipal lien from the Wyoming Valley Sanitary Authority against Paselo Logistics LLC in the amount of $537.59 plus interest of half per month.The orders came during the day while that at night the <a href="https://www.timesleader.com/news/local/521958/funding-for-bridges-fire-department-in-question-at-ashley-council-meeting" target="_blank">Ashley Borough Council asked its solicitor to start collecting back taxes owed to the borough.</a> Northeast Tax Revenue records show, as of March 15, Paselo Logistics is delinquent $46,529.92 for the years 2014 and 2015.Connolly also said the DEP was on site March 8 with officials from the Bureau of Abandoned Mine Reclamation looking at &#8220;what is believed to be an old mine opening shaft.&#8221; While on site, DEP officials took five soil samples to be tested for possible contaminates &#8220;specifically asbestos.When called for comment Wednesday afternoon, Johnathon Comitz of Comitz Law Firm, of Wilkes-Barre, who represents Paselo Logistics LLC, was not available.<div class="metaInfo"><bylineMeta>By Melanie Mizenkommizenko@www.timesleader.com</bylineMeta></div><div class="metaInfo"><shirttailMeta>Reach Melanie Mizenko at 570-991-6116 or on Twitter @TL_MMizenko</shirttailMeta></div>
