Bail sought for man granted new trial in 1991 slaying

EASTON, Pa. (AP) — An eastern Pennsylvania mother has pleaded guilty to child endangerment and agreed to testify against her ex-boyfriend in the beating death of her toddler daughter. Twenty-eight-year-old Heather Surget entered the plea Friday in Northampton County as part of a deal that includes a time-served sentence allowing her release from jail. Thirty-two-year-old Gary Foley Jr. is charged with beating 17-month-old Kannah Drew in February 2015 while Surget worked at a fast-food restaurant. Police said he said the child choked on a hot dog. Defense attorney Tyree Blair said Surget wanted to accept responsibility and didn't want to stay in prison because she is pregnant. Prosecutors said Surget and her four children lived in an unheated, garbage-strewn trailer. Surget said she couldn't afford to live elsewhere although the conditions "did bother" her.
