Bail denied for nursing supervisor who missed sentencing

<p>WILKES-BARRE &#8212; Luzerne County prosecutors will have to wait until February to ask a judge to revoke a probation sentence for a Hanover Township woman, charged with a second drunken driving offense since 2015.</p><p>Prosecutors July 27 filed a petition seeking to have Brianna Lynn Dixon, 21, of Hanover Village, jailed due to violations of a one-year probation term. She was charged with DUI after a crash June 29.</p><p>Wilkes-Barre police allege Dixon had a blood-alcohol level of .14 percent and marijuana in her system when she crashed in the area of 130 E. Division St., seriously injuring two passengers.</p><p>Judge Tina Polachek Gartley on Friday reluctantly continued the hearing to revoke Dixon&#8217;s probation upon a request by Attorney John Pike. The judge rescheduled the hearing for Feb. 7.</p><p>When arguments are heard to revoke Dixon&#8217;s probation, it will be more than six months since prosecutors filed the petition.</p><p>Pike asked for the hearing to be continued as he began defending Dixon on Tuesday when her previous lawyer, the Mark Mack Law Firm, withdrew from her case the same day. A review of court records show the hearing had been continued three times when Dixon was represented by the Mack firm.</p><p>Dixon has been jailed since Nov. 6 when a district judge modified her bail from $10,000 unsecured to $10,000 straight in relation to the June 29 crash. Dixon waived her right to a preliminary hearing that day, sending drunken driving charges to county court.</p><p>Prosecutors withdrew an aggravated assault DUI charge against Dixon at the preliminary phase.</p><p>When Dixon crashed on East Division Street, police said her driving privileges were suspended due to a crash at Brown and Holland streets in Wilkes-Barre in October 2015. She was 18 at the time.</p><p>When officers arrived at the crash at Brown and Holland, Dixon was attempting to remove a child from the wreckage, according to court records.</p><p>Dixon pleaded guilty to endangering the welfare of children, accidents involving injury and drunken driving. She was sentenced to a year on probation.</p><p>That probation term began after she finished serving a six to 12 month sentence on an unrelated simple assault charge.</p><style>
