Owner of property where stabbing occurred disputes ‘illegal boarding house’ reference

<p>WILKES-BARRE &#8212; An attorney for homicide suspect Anthony Dion Shaw filed a motion in Luzerne County Court seeking an appointment of a psychiatrist to conduct a competency evaluation.</p><p>Attorney David V. Lampman is requesting a court order from Judge Michael T. Vough that would hire Dr. Matthew A. Berger to evaluate Shaw to determine if Shaw voluntarily waived his right to a lawyer when he was questioned by investigators May 5.</p><p>Shaw, 42, of East Orange, N.J., is facing an open count of criminal homicide for the stabbing death of Cindy Lou Ashton, 39, inside her Nicholson Street residence in Wilkes-Barre Township. Her body was found by police May 2 when an officer performed a welfare check after she didn&#8217;t show for work.</p><p>Investigators believe Shaw and Ashton met on a dating website about a year before he allegedly killed her. Shaw arrived at Ashton&#8217;s residence May 1 to talk about their relationship and they agreed to remain friends with benefits, authorities report.</p><p>Ashton was last seen alive by a friend who left her residence at about 7 p.m. May 1 when Shaw allegedly arrived.</p><p>Investigators suspect Shaw purchased a Gerber folding knife and a pack of socks at Kmart on Wilkes-Barre Township Boulevard about 15 minutes before he arrived at Ashton&#8217;s residence. The store is about a mile from her home.</p><p>After Ashton&#8217;s body was found, investigators learned Shaw was hospitalized at Rutgers University Hospital after a failed suicide attempt May 3.</p><p>Investigators allege they recovered evidence from Shaw&#8217;s apartment and vehicle that Lampman claims was seized without a search warrant.</p><p>If Vough allows Berger to evaluate Shaw, Lampman said he will provide the psychiatrist with nearly 700 pages of medical records to review, and Berger will interview Shaw at the county correctional facility sometime in early March.</p><p>That will likely delay Shaw&#8217;s trial that is scheduled to begin March 3.</p><p>Lampman noted in the motion that Berger&#8217;s hourly rate is $500 and his services would not exceed $6,000 without additional approval.</p><style>
