LEAVES HEARING -- Accused killer James Milliner walks with county sheriff's
deputies from his pre-trial hearing Monday &nbsp;&nbsp;&nbsp;

 WILKES-BARRE -- Attorneys in the James Milliner homicide trial sorted
through a list of defense requests Monday morning delaying jury selection in
the case. &nbsp;&nbsp;&nbsp; 
 Senior Judge Bernard Brominski allowed the prosecution to admit evidence
that Milliner allegedly assaulted another man, Louis Abend of Wilkes-Barre, in
the same area where Robert Kline's body was found the morning of April 2. &nbsp;&nbsp;&nbsp; 
 Milliner, 25, of Loomis Street, Nanticoke, allegedly robbed and killed
Kline, 29, of Wilkes-Barre, and dumped his body on a dirt road off of New
Commerce Boulevard, Hanover Township. &nbsp;&nbsp;&nbsp; 
 Assistant District Attorneys Charles Coslett and Jeffrey Tokach contended
Milliner took Abend to the area three weeks before the Kline homicide. &nbsp;&nbsp;&nbsp; 
 Defense attorneys Michael Anthony and Demetrius Fannick argued there was no
connection between the alleged assault and the homicide. &nbsp;&nbsp;&nbsp; 
 The defense was able to keep out of the trial a statement Milliner
allegedly made to Timothy McCloe, a bartender at The Bar on North River
Street, the morning of the homicide. &nbsp;&nbsp;&nbsp; 
 Milliner allegedly said "he had recently gotten out of jail and that if
anyone crossed him, he would take care of them," according to the arrest
affidavit. Then Milliner allegedly showed McCloe a holstered revolver under
his jacket. &nbsp;&nbsp;&nbsp; 
 Brominski ruled the statement was not admissible, adding it was not
specific as to what "take care of them" meant. &nbsp;&nbsp;&nbsp; 
 The judge reserved ruling on whether to allow photographs of the crime
scene to be shown to the jury. He also said he would decide later whether to
allow the testimony of Frank Eastabrook, another bartender at The Bar. &nbsp;&nbsp;&nbsp; 
 According to the arrest affidavit, before Milliner left the bar on April 2
he gave Eastabrook a .38 caliber bullet and said "This is to remember me by if
you don't see me again." &nbsp;&nbsp;&nbsp; 
 Defense attorneys also learned Monday they would not hear testimony from a
Ronald Marx whom they subpoenaed as a witness. &nbsp;&nbsp;&nbsp; 
 Marx, according to his attorney John Moses, plans to invoke his Fifth
Amendment right against self-incrimination. &nbsp;&nbsp;&nbsp; 
 "Here's an individual that places himself at or near a scene that was a
murder," Moses said. &nbsp;&nbsp;&nbsp; 
 Coslett said Marx could face criminal charges for providing false reports
to investigators. The prosecutor stated Marx's statements caused investigators
to "spin their wheels" for a couple of weeks. However, Coslett did not detail
those statements. &nbsp;&nbsp;&nbsp; 
 One man already faces a charge of hindering the apprehension of Milliner.
Mark Yeager, a Nanticoke city councilman and friend of Milliner, allegedly
tipped off the defendant about his upcoming arrest, enabling him to flee the
state. &nbsp;&nbsp;&nbsp; 
 The defense attorneys arranged to interview Amanda Mantz this afternoon.
Mantz, who lived with Milliner at the time of the shooting, testified against
him at his preliminary hearing. &nbsp;&nbsp;&nbsp; 
 Coslett said Mantz will be the prosecution's final witness at the trial. &nbsp;&nbsp;&nbsp; 
 Milliner is held without bail in the Luzerne County Correctional Facility. &nbsp;&nbsp;&nbsp; 
 The prosecution is seeking the death penalty for Milliner with a
first-degree murder conviction. &nbsp;&nbsp;&nbsp; 
 Attorneys are scheduled to meet at 10 a.m. today to continue pretrial
arguments.
