First Posted: 10/2/2014 WILKES-BARRE &#8212; Family of the late Kevin Miller filed a motion Thursday in a civil suit calling for a videotape deposition of the man who pleaded guilty in March to hitting the 5-year-old boy and fleeing the scene in Dec. 2012.
Thomas W. Letteer Jr. is currently housed in the State Correctional Institute at Camp Hill, which does not allow videotape depositions due to security concerns, the motion says.
&#8220;SCI Camp Hill&#8217;s knee-jerk refusal&#8221; necessitates a court order, the motion continues.
Language in the document calls the prison&#8217;s position &#8220;unsupported,&#8221; and says the Pennsylvania Rules of Civil Procedures authorizes videotape depositions &#8220;specifically.&#8221;
According to a rule also filed Thursday, Letteer has until a Nov. 10 hearing date to show cause why the motion should not be granted.
Letteer pleaded guilty in March to accidents involving death, a second-degree felony, in connection with the Dec. 21, 2012 crash.
Wilkes-Barre city police and Luzerne County detectives alleged Letteer was driving the red 1999 Pontiac Grand Am that struck Kevin as the boy crossed North Street with his parents and two brothers after they left a Christmas party that snowy December night.
Then, investigators and witnesses have said, Letteer drove off without stopping.
